A LANDOWNER was granted a High Court order yesterday preventing a forestry company spraying a weedkiller on a tree plantation on lands he has leased to the company since 1994.

The injunction, granted by Mr Justice Geoghegan to Mr Graham Smyth, Ballydarton House, Fenagh, Bagenalstown, Co Carlow, prevents Silver Fir Enterprises Ltd, Marine Road, Dun Laoghaire, Co Dublin, from using a weedkiller, Calibre, on the plantation.

Mr Smyth claimed he had been informed by letter from the Department of Agriculture that the use of the herbicide on forestry plantation was illegal.

The company had leased the land from Mr Smyth for a 12 year period in May 1994.

He said that on November 20th last, Silver Fir Enterprises began spraying the forestry plantation with the weedkiller. He believed its use would cause irredeemable damage.

The injunction continues until Monday week.
