The High Court yesterday refused to allow leave to a group of residents to challenge a decision of the Environmental Protection Agency.

The EPA had decided to give a licence to Meath County Council to develop a major landfill in the Navan area. The objection came from residents of Kentstown, Co Meath.

Mr Justice Ó Caoimh held that the residents, members of the Boyne Valley and Newgrange Environmental Protection League Ltd, had failed to establish substantial grounds to justify their challenge.

He said it was clear that the licence did not restrict the landfill to material from Co Meath but it was as yet unclear if it would be used on a wider basis, as the adjoining counties had not adopted the waste plan. The fact that it might be used for waste from adjoining counties had not been shown to change the nature of the proposed use.
