A Co Limerick man challenged the new divorce legislation in the High Court yesterday. Mr Justice Costello, President of the High Court, reserved judgment in the proceedings brought against the State by Mr Denis Riordan, of Clonconane, Redgate, Co Limerick.

Mr Riordan sought a declaration that the Family Law (Divorce) Act 1996 is repugnant to the Constitution. He claimed it is contrary to Article 41 of the Constitution.

Mr Donal O'Donnell SC, for the State, said they were objecting to the entitlement of either Mr Riordan or the High Court to entertain a challenge to legislation to amend the Constitution which had been approved by the people in a referendum.
