A Dublin man allegedly caught committing rape was freed on his own bail yesterday despite Garda objections.

A Dublin man allegedly caught committing rape was freed on his own bail yesterday despite Garda objections.

The 24-year-old man, who cannot be named for legal reasons, appeared in Dublin District Court accused of committing rape, buggery and oral rape against a teenage girl on June 16th last in north Dublin.

Det Sgt Tom McCarrick told the court he arrested the defendant that morning and was seeking a remand in custody because he believed the defendant would not stand trial. However, Ms Yvonne Bambury, defending, said the man had been living at his parent's home for the past four months in the knowledge that he could be prosecuted.

State solicitor, Mr Liam Mulholland, said the charges would "concentrate the defendant's mind" and added there was evidence he had been caught redhanded by gardai.

Judge John McDonnell said he was not allowed to oppose bail on the grounds of being caught "redhanded". He freed the defendant on his own bail of £500 to appear for a book of evidence on December 11th and said gardai could apply to the court for a warrant if there was any "untoward incident".
