A MAN faced new charges at the Special Criminal Court in Dublin yesterday following the confusion over the delisting of Judge Dominic Lynch from the court. Mr John Quinn (28), of Faha, Patrickswell, Co Limerick, was charged with three offences arising from the Garda investigation into the murder of Det Garda Jerry McCabe in Co Limerick in June. He was charged with IRA membership on June 9th last, possession of ammunition at Patrickswell, Co Limerick, on June 6th and conspiring with others between June 5th and June 8th to commit a robbery at Adare, Co Limerick.
Det Insp John Kerin gave evidence of arresting Mr Quinn at Green Street in Dublin at 10.50 a.m. yesterday under Section 30 of the Offences Against the State Act. He said he arrested him for possession of ammunition at Patrickswell.
Cross-examined by Mr Quinn's solicitor, Mr Michael Farrell the detective inspector said he was aware that Mr Quinn faced other, earlier charges. He said he understood that because of an administrative error in the Department of Justice the charges were not properly before the court. Mr Farrell said his client had been freed on bail by the Supreme Court on July 31st. The court remanded Mr Quinn on independent bail of £20,000 and his own bail of £1,000 until December 10th.
Two other men facing charges arising from the Garda investigation of the murder of Det Garda, Jerry McCabe were also remanded in custody until December 10th.
Mr Michael O'Neill (45), of Lisheen Park, Patrickswell, and Mr Jeremiah Sheehy (36), of Abbey Park, Rathkeale, Co Limerick, are each charged with possession of a firearm with intent to endanger life at Ad are, Co Limerick, on June 7th, the day on which Det Garda Me Cabe was shot dead. Mr O'Neill is also charged with IRA membership on June 18th and Mr Sheehy with IRA membership on June 8th.
