A man who was given a suspended sentence on Thursday for harassing his former girlfriend with pornographic matter is back in custody for Christmas because he has already breached his release conditions.

Darren Maguire, aged 30, of Ballyshannon Road, Coolock, Co Dublin, had been ordered not to contact the woman except through a solicitor. But within hours of leaving the court he tried to approach her in a city centre toyshop, where he became aggressive.

He was brought back yesterday before Judge Elizabeth Dunne, who said it was "beyond a shadow of a doubt" that there was enough evidence to remand him in custody until January 31st. She recommended that he undergo psychiatric assessment while in custody.

Maguire had pleaded guilty on Thursday at Dublin Circuit Criminal Court to assault and harassment of the 25-year-old victim on dates between November 1998 and January 1999.

Judge Dunne had imposed a three-year suspended sentence after hearing how he sent his former girlfriend a "barrage" of obscene parcels, letters and notes. She prohibited him from contacting his victim.
