A man who lost the use of his right arm after he was thrown from his motorcycle when it collided with a tractor in Co Cavan has settled his High Court action for damages.

He said he was trying to avoid a "crater" pothole.

Mr Breen McDonnell (24), from Mountnugent, Co Cavan, sued Cavan County Council over the accident near his home on April 16th, 1994.

Mr Justice Johnson was told the case had been settled. The judge struck out the case with an order for the plaintiff's costs.

In evidence, Mr McDonnell said he was driving his scrambler bike at about 40/45 m.p.h. on the wrong side of the road, when it collided with the tractor. The bike was unlicensed and he was not insured.

He said he had to drive on the wrong side to avoid a pothole. Cavan County Council denied all the claims and pleaded that if Mr McDonnell sustained the injuries alleged, this was caused entirely by his own negligence in driving at excessive speed and permitting his bike to go out of control.
