A 27-year-old law graduate yesterday failed in his attempt to have bail conditions relaxed so that he can return home pending an appeal of his conviction for harassing his elderly neighbours.
It is part of a long-running dispute which has already resulted in his being successfully sued for €4,000 in damages.
Troy Cremin had sought to have relaxed a bail condition imposed by Judge David Riordan preventing him from residing at his family home at Palm Springs, Ardarrig, Douglas, in Cork.
Judge Riordan had imposed the condition as part of his bail terms pending Cremin's appeal of his conviction at Cork District Court for harassment of his neighbours.
Yesterday at Cork Circuit Court, Cremin said he was currently living at a B&B on the Western Road and it was causing him and his parents considerable inconvenience as they were driving over to him three or four times a day. It was also a financial burden on his parents, who are supporting him. He said that he was no longer able to drive following a conviction for a motor offence.
Mr Troy, who is in receipt of a disability allowance following an accident at the age of 17 when he fell through a roof and was injured, said he would abide "absolutely" with the terms of an injunction imposed on him by Judge Moran following a civil case taken by the neighbours against him.
Earlier, Sgt Tom Ryan of Douglas Garda station said that on the night following the neighbours' successful civil suit against Cremin on April 21st last, a firework was set off at the back of their house. It was captured on CCTV cameras.
"Since Mr Cremin stopped residing at Ardarrig, things have been peaceful there. There have been no complaints and Mr Hartigan said that his quality of life has improved," Sgt Ryan said.
