A MAN who was prosecuted by Monaghan County Council for creating an illegal dump on his mother’s farm was warned by a judge yesterday that he would face a jail sentence if he ignored a court warning to clean up the area within a month.
Martin Murphy, of Lagan, Tullynahinera, Castleblayney, was fined €2,000 by Judge Seán MacBride at Carrickmacross District Court and ordered to pay a total of €1,125 in costs and expenses to Monaghan County Council arising from the illegal dumping at Binmore on November 26th last year. Enda O’Carroll, acting for the local authority, told the court that Murphy had ignored a warning notice which was served upon him by the council for the illegal dump.
He said Murphy had been previously convicted for a similar offence.
Imposing the penalties, Judge MacBride said if Murphy ignored the ruling and failed to clear up the area within four weeks he would face a jail term.
A charge against the accused’s mother, Bridget Murphy, also of Lagan, Tullynahinera, was struck out by the judge.
