A former RUC constable convicted of murdering his wife and two children was yesterday granted leave to apply for a judicial review to compel the Central Services Agency to hand over medical records he hopes will clear his name.

John Torney (43), was sentenced to life imprisonment in March 1996 for murdering his wife Linda, son John (11), and daughter Emma (13). They were found shot dead in the family home in Cookstown, Co Tyrone, in 1994. Torney claimed his son shot his mother and sister and then killed himself with his father's police revolver.

Torney's lawyers have sought the medical records of his wife and children which had been lost but were found in March.
