An application is to be made to revoke the bail of a man accused of the murder of a Connemara schoolgirl, Siobhan Hynes.
Mr John McDonagh (26), Demense, Carraroe, Co Galway, is charged with murdering Ms Hynes, whose body was found on the beach at Tismeain in December 1998.
He has been free on bail since last year when he was first charged. Conditions of bail were that he sign on regularly at a Garda station and reside at a Dublin address.
Last week he was arrested in Dublin and charged with soliciting a prostitute in the Clondalkin area. When he was brought before Dublin District Court, dressed in working boots, a T-shirt and jeans, gardai said he had been living rough in a van for the past few weeks.
Yesterday the court was told by Mr Liam Mulholland, solicitor for the DPP, that the State was seeking to have the murder charge bail revoked as Mr McDonagh had breached the terms of it, but Mr McDonagh's solicitor, Ms Yvonne Bambury, objected as she had had no notice of this application.
Judge Thomas Fitzpatrick was told bail had been set by the High Court, but liberty had been given to the State to apply to the District Court to revoke it if it was breached. Judge Fitzpatrick said that in that case the appropriate place to make the application was in Galway District Court, which sits again on Tuesday.
On the soliciting charge, he remanded Mr McDonagh in continuing custody to appear again in Dublin District Court on September 5th. Mr McDonagh said nothing during his appearance before the court.
