The trial of a Dublin man accused of murdering his father was adjourned yesterday after the jury was told the man was not well enough to hear evidence.
At the Central Criminal Court Mr Patrick MacEntee SC, for Mr Anthony McAuliffe, told the court his client did not feel well and needed to be seen by a doctor. Mr McAuliffe has a history of psychiatric illness and is being treated in the Central Mental Hospital since he attacked his father with a knife, causing him fatal injuries.
Mr Justice Butler was told Mr McAuliffe would not be well enough to hear evidence until today. Mr McAuliffe (43), Brookwood Glen, Artane, Dublin, has pleaded not guilty to the murder of his father, Mr John Tony McAuliffe (71), in October 2001.
Man sought in Germany held
A High Court judge has further remanded in custody until today a Nigerian man arrested here two weeks ago. The German authorities are seeking the man's extradition on charges of fraud and forgery.
Mr Samuel Koulibaly (37) who is also known as Samuel Onojighovie, has been in custody since his arrest. Last week the court was told the German authorities had 18 days from the date of arrest to serve the relevant papers.
When the case was mentioned yesterday, Ms Sabina Purcell, a State solicitor, told Mr Justice Smyth that the Irish authorities had advised the German authorities of the strict time limits but the documents had just arrived and were not yet ready for service on Mr Koulibaly. They were in English and German and required to be checked by the Irish authorities before service.
Ms Purcell said the 18-day period ended tomorrow. Mr Justice Smyth adjourned the matter until today.
Mr Koulibaly was arrested in Tallaght, on July 1st. When the case came before the High Court two weeks ago, Mr Justice White said there had been publicity prior to the matter coming before him of a nature which he considered to be inappropriate.
Boy (14) to face assault trial
A 14-year-old boy charged in connection with a burglary in which it is alleged that a woman was set on fire and had a pot of boiling water poured over her and a man was badly beaten and stabbed, was sent forward for trial to the Circuit Court yesterday.
The boy is facing six charges for assault causing harm, violent disorder, two counts of endangering their lives and burglary at a house in Dolphin's Barn, during the night of New Year's Eve and morning of January 1st last, the Dublin Children's Court was told.
Judge Bryan Smyth remanded him in custody to the next sittings of the Dublin Circuit Criminal Court. A youth aged 16 and an 18-year-old woman, who was a minor at the time of the alleged offences, were returned for trial to the Dublin Circuit Criminal Court earlier this week.
Irish fishing vessel detained in Cobh
An Irish-registered fishing vessel has been detained by the Naval Service for alleged breach of fishing regulations. The Mary J was apprehended about 50 miles south of Waterford and was escorted into Cobh, Co Cork, yesterday.
This is the 18th fishing vessel to be detained by the Naval Service for fishery-related offences to date this year.
