No explanation was being offered yesterday for the mistakes made in the prosecution of the case against Ms Nora Wall and Mr Paul McCabe for the alleged rape of a 10-year old girl.
They were released on bail on Tuesday following their successful appeals against conviction.
This came about when the Director of Public Prosecutions admitted the non-disclosure of relevant information to the defence.
Specifically his counsel told the Court of Criminal Appeal that one witness had been called whom the DPP had decided not to call. She gave detailed corroborative evidence of the alleged rape.
Neither the office of the DPP nor that of the Chief State Solicitor would make any comment yesterday on what happened.
A spokeswoman for the DPP said that he was precluded from discussing cases, and that this prohibition included questions such as how his decision came to be disregarded.
A spokeswoman for the Chief State Solicitor, who provides a solicitor service for the DPP, referred all queries to the DPP.
A spokeswoman for the Attorney General, whose office is responsible for that of the Chief State Solicitor, said he would not have anything to do with instructions between the DPP and the Chief State Solicitor.
The relationship between the offices of the DPP and the Chief State Solicitor is one of the issues examined in a report due to be considered by the Government when it resumes work in September.
This is the report of a study group into the public prosecution system, under the chairmanship of the former secretary to the Government, Mr Dermot Nally.
It was asked to examine legal and organisational arrangements for the public prosecution system, including whether there should be any changes in the functions of the criminal trials section of the Chief State Solicitor's Office and the Director of Public Prosecutions and his office.
It is thought that the DPP, Mr Eamonn Barnes, has been concerned for some time that his office has no control over the section of the CSS office which effectively works for him.
The integration of this section of the CSS office into the office of the DPP is one of the issues addressed in the report.
