A High Court action over a male prison officer's transfer to Wheatfield Prison following a complaint against him by a woman officer in Mountjoy Prison has been settled.

Assistant chief officer Vincent Malone (47) had sued the Minister for Justice and the governor of Mountjoy prison over his transfer from Mountjoy to Wheatfield Prison in Clondalkin. In an action which opened last week, Mr Justice O'Donovan was being asked to decide whether fair procedures had been adopted by the prison authorities in the transfer of Mr Malone. The court was told Mr Malone had complained he was verbally abused by a woman prison officer, Ms Mary Tierney, and also that she made complaints about him, alleging he glared at her and called her "a slut".

Following talks between lawyers for the sides yesterday afternoon, Mr Justice O'Donovan was told the proceedings had been settled and could be struck out.
