The High Court has provisionally fixed December 14th for the hearing of proceedings brought by the Minister for Justice, Mr Michael McDowell, and his wife, Prof Niamh Brennan, against Roscommon County Council in relation to their holiday home.

They were given leave last October 21st to bring a challenge by way of judicial review to the council's handling of their application for an extension of the duration of planning permission for their incomplete holiday home at Levagh, Rooskey.

Last month, their counsel said they were anxious to get the matter resolved. The building was incomplete and open to the elements, the court was told.

Yesterday, the president of the High Court, Mr Justice Finnegan, said no priority had been given to the case.

Mr Michael Collins SC, for the applicants, said the matter was urgent because remedial work had to be done to the building. It had been necessary to erect security fences because of the media interest.

Mr Justice Finnegan fixed a provisional date for December 14th.
