Flooding at the Co Kildare offices of the Bovale Developments auditors destroyed documents relating to the accounts of the company for the 1989-90 financial year, the tribunal heard yesterday.

At Christmas 1992 at Mr Joseph O'Toole's offices in Celbridge, water from a burst pipe seeped into a storage area, and even when files were dried they could not be separated, Mr O'Toole said. When the company moved offices they were destroyed.

In February Ms Caroline Bailey, the company's book-keeper, told Mr Justice Flood that Bovale's records covering the same period were destroyed in a fire in Finglas in 1998.

The tribunal is investigating allegations that Mr Michael Bailey, a company director, paid £40,000 to Mr Ray Burke in June 1989.
