A group of Co Dublin residents who formed a limited company to challenge planning permission for a housing scheme in their area, have failed in their High Court attempt to block the development.

Refusing Springview Management Co Ltd leave to judicially review the decision of South Dublin County Council in granting planning permission for a number of houses at Ash Park, Esker Road, Lucan, Mr Justice O'Higgins said the residents had failed to demonstrate substantial grounds for their challenge.

The company brought the proceedings against the local authority and Cavan Developments Ltd, claiming the company had breached planning permission by starting work before the scheduled date.

Mr Justice O'Higgins found that notices exhibited on the site by the developer complied in full with planning regulations and held that some of the points which the applicant company had made were frivolous.

He refused to make an order for costs on the grounds that the developer had breached conditions by starting work prior to the scheduled date.
