The District Court will rule within nine weeks on the release to his family of documents relating to the case of Daniel McAnaspie.
The case came before Judge Conal Gibbons yesterday following a ruling in the High Court last December that the McAnaspie family had the right to ask the court for reports into the care of their brother, who was killed two years ago while in the care of the HSE.
His sister Cathriona said she believed the reports might reveal his death could have been avoided and could assist her in getting an inquiry into the circumstances leading to his death.
In the High Court Mr Justice George Birmingham also ruled that the media could report on the family’s application to the District Court, although the court could impose restrictions on what may be published, especially if the material related to a living child in care.
In the District Court yesterday, lawyers agreed that the guardian ad litem would redact the reports. It was also agreed that the Chief Prosecution Solicitor, on behalf of the DPP, would redact the reports to ensure they did not prejudice the pending criminal trial of those charged with his murder.
