A High Court judge has said he will give judgment in two weeks on the application by the horse-trainer, Mr Aidan O'Brien, and a number of stud companies for leave to challenge a decision of South Tipperary County Council granting planning permission for an incinerator in the area.

The application by Mr O'Brien and Coolmore, Castlehyde and Associated Studs for leave to bring the challenge through judicial review proceedings was heard over four days by Mr Justice Ó Caoimh and concluded yesterday.

The site of the proposed €25 million development is near the premises of Mr O'Brien at Ballydoyle and of the stud companies. The application for leave to seek judicial review of the council's decision is opposed by the developer of the proposed incinerator, National By Products Ltd.
