Sentence has been adjourned in the case of a Co Wexford Transport company whose truck was involved in the death of two women in Co Kilkenny.

Nolan Transport, Oaklands, New Ross, Co Wexford, pleaded guilty before Judge Raymond at Wexford Circuit Criminal Court to their failure to secure a load of steel coils on the trailer that shifted near Thomastown, Kilkenny, in July 2007.

The accident caused the deaths of Vanessa McGarry and Mary Lonergan.

The court was told by defence counsel, John O’Kelly, yesterday that five personal injury claims had been settled with one outstanding claim, that of Louise Lonergan, daughter of Mary Lonergan. He also said that the defendant is paying Health and Safety Authority costs and Garda costs.

He said the costs on personal injury claims came to some €400,000.

The court was told that Rafal Luszacki was driving an articulated lorry belonging to a New Ross Haulage company, Nolan Transport, when its load of heavy steel coils shifted near Thomastown in July 2007.

Nolan Transport represented by its managing director, Patricia Nolan, pleaded guilty to the charge that they failed to secure the load on the trailer.

The trailer contained six large steel coils each weighing about five tonnes.

One of the steel coils hit the car being driven by Mrs Lonergan.
