A Dublin man, whose prison sentence was increased from 12 to 16 years when it was appealed to the Court of Criminal Appeal in 1988, had it restored to the original term yesterday.

Mr Derek Lambert, of Avondale House, North Cumberland Street, Dublin, claimed he had been a victim of a miscarriage of justice. He had pleaded guilty in the Circuit Criminal Court in February, 1987, to charges of burglary, false imprisonment and robbery.

Yesterday in the Court of Criminal Appeal Mr Justice O'Flaherty said that if all the matters had been made plain to the 1988 Court of Criminal Appeal hearing it most likely would not have embarked on the hearing of Mr Lambert's appeal and would have allowed an abandonment. Therefore there would have been no increase in the sentence.
