A CASTLEISLAND-BASED solicitor and his brother have been sent for trial to the current sessions of the Circuit Criminal Court in Tralee on allegations of forgery relating to health insurance claim forms in 1994.
Judge Terence Finn’s decision yesterday at a special sitting of Tralee District Court to send both men for trial was on foot of a preliminary inquiry at special sittings of the court in Tralee into the matter.
Judge Finn said he was satisfied that each of the accused should be sent forward for trial in respect of 10 charges.
Solicitor Patrick Enright (49), Glenlarehan, Castleisland, and his brother Denis Enright (45), a farmer, of Knockardtry, Castleisland, are being sent forward on 10 charges of allegedly forging documents purporting to be New York Life Insurance Company health insurance claim forms on various dates between January 1994 and August 1994, and in various amounts each under $5,000 amounting to a total sum of just over $38,000.
The alleged offences are contrary to the Forgery Act 1913.
State Solicitor Malachy Boohig said the application to have the matter sent forward was from the Director of Public Prosecutions.
Patrick Cullinance, counsel for Patrick Enright, asked for a stay on reporting of the case until Monday next.
However, Judge Finn refused this application.
Judge Finn returned both men to the present sittings at the Circuit Criminal Court in Tralee on Tuesday next, remanding both men on bail on their own bond of €1,000.
Certificates of legal aid were granted for both men.
Mr Boohig indicated the State would be seeking an adjournment of the matter on Tuesday to the following Circuit Court sessions in Tralee.
