The state is to seek to revoke bail granted to a Co Galway machine driver accused of rape and murder, the High Court has been told.

Mr Joe Barnes, for the Director of Public Prosecutions, told Mr Justice O Caoimh that the application would be made before Galway District Court on Monday, on the grounds that Mr John McDonagh, of Demesne, Carraroe, had breached an important condition of his bail.

Mr Barnes said the High Court had accepted a Dublin address where Mr McDonagh was to have stayed but that he had twice changed residence without notifying gardai.

On the application of Mr Barry White SC, for Mr McDonagh, the High Court yesterday varied his bail conditions to allow him to live with his brother, Padraig, in Dublin. Mr White handed the address into court.

He said Mr McDonagh's landlords at the previous addresses had received hate mail after their addresses had been published in the media. Mr McDonagh is accused of raping and murdering 17-year-old Ms Siobhan Hynes at Tishman Beach, Carraroe, almost two years ago. While his bail on these charges stands, he has been held in custody since he was arrested two weeks ago on charges of soliciting a prostitute.

This charge had been adjourned until tomorrow in the Dublin District Court, when an application is to be made to consolidate existing bail to apply to all charges.

Mr Justice O Caoimh was told that when granted bail Mr McDonagh had been ordered to live away from the Carraroe area and had moved to Dublin.
