A jury has been told that a then Leaving Certificate student who claims she was raped asked the defendant to have sex with her and when he refused she shouted "rape". The evidence was given at the Central Criminal Court on the third day of a trial by a young man who told the jury he was present when it happened and he knew the alleged victim.

He told Mr Eanna Mulloy (with Mr Denis Vaughn Buckley SC), prosecuting, that the 21-year-old alleged victim pulled down her underclothes and said to the defendant: "Come on and f..k me". He said the defendant wouldn't and so she started to shout "rape".

He told Mr Christopher Meehan, defending, in cross-examination, that the defendant's brother had asked everyone what his brother was accused of. The witness couldn't recall anyone answering.

The 21-year-old Co Sligo man has pleaded not guilty to two charges of rape and sexual assault on July 3rd, 1995. The jury also heard another young man, who knew the alleged victim, tell how the defendant had appeared on the scene and shouted: "I didn't do it. I didn't do it." He said all the "lads" who were there accused him of raping the alleged victim, but he strongly denied it.
