A test case concerning the validity of a newly introduced device for measuring intoxication in drink-driving cases will be heard by the High Court next week.

Yesterday, Mr Justice Kelly said a large number of prosecutions were being held up pending the High Court determination and it was right the matter should be cleared up as soon possible. He fixed the matter for hearing on December 23rd.

The new gauge for measuring intoxication, known as the Lion Intoxilyzer, indicates, on an instant printout, the level of drink taken from a breath test. The device has been challenged by scores of motorists facing drink-driving charges.
