Travellers who moved back on to a halting site after they were evicted by the sheriff yesterday won costs of a court case after challenging an attempt to have the eviction order against them renewed.
Ms Bridget and Mr Joseph McGinley, Mr Michael and Ms Winifred McGinley and Mr Simon and Ms Tilda Doherty had contested South Dublin County Council's second attempt to remove them from their caravan bays at the Old Castle Park Close official halt in Clondalkin, Co Dublin.
Earlier this month, Dublin District Court heard that warrants for possession of the bays had been issued because the occupants were in breach of licensing agreements under which they got the accommodation.
The council obtained the orders under a procedure known as "good estate management", which allows a court to evict people without going into the reasons for doing so. Last August, the sheriff evicted them, but later they moved back. Under a new legal provision, the council applied to the court to renew the eviction order. The case had been adjourned until yesterday.
Judge Mary Collins said the respondents were entitled to costs for their first appearance in court, but not for yesterday. She measured costs at €300 in total - €100 for each couple.
