THE TRIAL of four gardaí accused of forcing entry to a flat and assaulting its young male occupant has continued in legal argument at Dublin Circuit Criminal Court.

Alan Conlon, Eoin Murtagh, Claire Delaney and Seán O’Leary have pleaded not guilty to forcing entry at a Basin Street Upper premises, entering as a trespasser and assaulting Owen Gaffney (21) causing him harm on February 17th, 2008. Gardaí Conlon, Murtagh and Delaney have also pleaded not guilty to the false imprisonment of Fidelma Gaffney.

Earlier, a forensic scientist told Patrick McGrath, prosecuting, that she found a mixed DNA profile containing all elements of DNA profiles for Mr Gaffney and Garda Murtagh on the handle of Garda Murtagh’s seized baton.

Dr Diane Daly said this mixed profile was a million times more likely to have originated from Mr Gaffney and Garda Murtagh than Garda Murtagh and an unknown person. The trial continues.
