What the court has ordered.
• The Adoption Board must procure the cancellation of the entry in the Register of Foreign Adoptions of Tristan.
• Suryani, the natural mother of Tristan, is appointed his sole legal guardian and is to have sole custody of him.
• Joseph and Lala Dowse, the adoptive parents, are ordered to pay maintenance for his support.
• A lump sum payment of €20,000 is to be paid into the court now for the child's benefit.
• Maintenance in the sum of €350 a month is to be paid until Tristan is 18 years. Of this, €175 a month is to be paid directly into the bank account of his natural mother Suryani and a further €175 a month is to be paid into court to accrue for his benefit.
• Both sums are to be paid on the first day of each calendar month, starting on February 1st, 2006.
• These sums will increase annually in accordance with the annual increase in the consumer price index.
• These sums will remain in court until Tristan reaches 18 years on June 26th, 2019, although the court may direct payments while he is a minor for his benefit. When he reaches the age of majority, the sums shall be solely his property.
• On his majority, a lump sum of €25,000 will be paid on or before June 26th, 2019, for his benefit. The issue of continuing dependency will then be reconsidered and assessed by the court.
• Tristan will continue to enjoy all rights to the estates of each of Joseph and Lala Dowse as if he had remained their lawful child, including the right to bring an application in respect of either of their estates under the Succession Act 1965.
• Tristan shall remain a citizen of Ireland.
• The case will be reviewed on July 3rd next to ensure the orders have been complied with and to review Tristan's circumstances.
• Suryani or anybody authorised to act on her behalf has liberty to apply to court for payments for Tristan.
• Mr Dowse should enter into an insurance bond of €120,000 to secure the payment of the sums into court in the event of Mr Dowse dying before Tristan reaches 18 years.
• Tristan has been made a ward of court.
• The accountant of the Courts of Justice will deal with the sums when lodged and also invest the cash carried over as directed by the Registrar of Wards of Court.
