A DUBLIN WOMAN who was celebrating at a neighbour’s 21st birthday party, broke her arm when she was flung against the DJ’s sound system, a judge has been told.

Judge Joseph Mathews heard that Marian Orr (50) and her daughter, Tracey, were dancing when the incident occurred.

Ms Orr, Tymon North, Tallaght, Dublin, told her counsel Aaron Shearer that a couple who were twirling cross-armed to the music bumped into her. “I was knocked backwards with force and fell against the tripod holding up a sound amplifier which toppled over and fell on me.”

She said the heavy amplifier had fallen across her breaking her right arm and she was pinned underneath it.

Ms Orr sued International Sports Activities Ltd which trades as Astropark at Greenhills Road, Tallaght, where the party had been held. She claimed Astropark had been negligent in having allowed the amplifier to have been positioned on or too close to the dance floor creating a hazard to dancers.

Judge Mathews said it would be unfair to find Ms Orr guilty of contributory negligence. It had been several months before she had recovered from her injury and he awarded her €7,750 in damages.
