Cambridge, Massachusetts - Lawyers for British au pair Ms Louise Woodward have filed a motion asking that a medical examiner's office hand over evidence from another case in which a former coroner neglected to perform a crucial test.

The motion comes after recent disclosures that Dr Gerald Feigin failed to perform a routine heart test on a man who was believed to have died as the result of a beating. The death was apparently due to congenital coronary disease. Dr Feigin is the same coroner who performed the autopsy on eight-month-old Matthew Eappen, who died while in the au pair's care.

In a response filed by the Middlesex County district attorney's office, prosecutors said Ms Woodward's lawyers had already had a chance to bring up any concerns they have with Matthew Eappen's post mortem.

The Woodward case is on appeal before the state Supreme Judicial Court.
