A teenage girl who performed oral sex on a youth she had only met a short time before told a Central Criminal Court jury he raped her, despite her saying she did not want sexual intercourse.
The alleged victim also said she had earlier initiated oral sex with another youth she had met for the first time at a place known as "the log" in a wood beside a south Dublin convent. She was aged 15 at the time and agreed she was "a little drunk" from drinking cider.
The now 17-year-old told Mr Patrick Gageby SC, defending, that her screams were answered by some of the other 40 or more boys and girls who met in the same area, but they failed to find the accused youth, who was later traced by gardai and presented them with a typed statement denying the rape.
The now 19-year-old man has pleaded not guilty to raping and sexually assaulting the girl on October 17th, 1997, beside St Raphaela's Convent, Upper Kilmacud Road, Stillorgan.
In reply to Ms Miriam Reynolds SC, prosecuting, the alleged victim said she bought eight pint cans of cider that night with her girlfriend. They had decided to go to the "log" because other friends had told them about the scene there.
She recognised a number of people when she arrived and sat around talking and drinking with them for a while. Many of them were "meeting" and she "got off" with one fellow with whom she went into the bushes. "I was `meeting' for a while by kissing at first but then it went a bit further and I gave him oral sex," she said.
She met the youth shortly after she went back to the "log" and he put his arm around her. She liked him and accepted his invitation to go into the wooded area with him. "I was just going to `meet' him and we were kissing each other when he asked for oral sex," she said.
The alleged victim said she agreed and was down on her knees for this purpose when he pushed her over on her back. She did not feel concerned at this and they continued kissing when he asked if he could have sexual intercourse with her. She said no but he tried to coax her to agree.
She felt him pull her jeans down roughly and then he raped her, she said. She screamed and he put his hand over her mouth while he told her to shut up. Within seconds he stopped when they heard people coming towards them. He then ran off.
She said she went back to her girlfriend and told her what had happened. Her friends told her to go to the Garda but she was reluctant because her parents would find out, but then she agreed and lodged a complaint.
Cross-examined by Mr Gageby she agreed she did not make a formal complaint to gardai until a fortnight later because of her reluctance to admit what went on.
