A WEXFORD teenager who had intercourse with a woman while she lay unconscious after drinking poitin in a Courtown car park two years ago has been remanded on bail for sentence by the Central Criminal Court.
Twelve hours after she was attacked, the 18 year old victim was found still unconscious and naked from the waist down in the carpark and was rushed to intensive care in Wexford General Hospital.
Later it was claimed that three men had had intercourse with her, one of them twice, while she was unconscious from drink Det Garda Thomas Byrne told prosecution counsel Mr Joseph Mathews SC and Mr John Peart SC.
Det Garda Byrne said it was believed the woman was plied with wine and then given poitin by her attackers.
A now 16 year old youth pleaded guilty to aggravated sexual assault of the victim on June 12th, 1994. He was remanded on continuing bail to November 21st by Mr Justice Flood for a report on the victim to be prepared.
Det Garda Byrne said the woman had been visiting a relative. She had one or two drinks in a hotel on the night of the assault before going into the car park with girlfriends at 10.30 p.m. They met four or five youths, including the defendant.
In a statement made in the presence of his mother, the defendant said he did not join the others in drinking wine and a bottle of colourless liquid which was consumed "from the neck".
He said that at one stage the victim went to a hotel. Later he met her again in the car park where she stood in front of him and kissed him.
He said he got on top of her and had intercourse with her while she was unconscious. Afterwards he called on her to get up but she was unconscious.
He walked away a short distance and met some of his friends who had been drinking with her earlier.
On telling his friends what he had done, two of them had intercourse with her and one did it twice, he said.
He told gardai he remembered this youth having sex with the victim for the second time and another youth telling him to hurry up as it was "his turn". When he returned to the car park the next day and saw the gardai there he realised what he had done.
Det Garda Byrne said the defendant apologised to the victim in his statement and said he knew she had not consented.
Mr Patrick MacEntee SC, defending, said his client had pleaded guilty to the charge of aggravated sexual assault which had been substituted for an earlier indictment. The defendant unreservedly accepted the victim had been grievously wronged.
