Clerys workers and company law

Sir, – According to company law, in the event of a liquidation, monies owing to the Revenue Commissioners for PRSI, VAT, Income Tax, etc, are deemed to be priority payments.

Why are statutory redundancy payments not included in the same category? If there are no funds left in the kitty after preferential payments are dispensed with, the State will ultimately have to step in and settle whatever payments are due.

After all, why should Clerys’ workers have to suffer the indignity and stress of waiting for this process to take place?

I call on the Minister for Business and Employment Ged Nash to put pressure on his Fine Gael colleagues to support an urgent amendment to company law to give priority to statutory redundancy payments.

If Fine Gael is unwilling to support such a measure, then it’s time to pull out of Government. A Labour Party that is powerless to effect such change is clearly not in a position to represent the needs of its supporters. – Yours, etc,
