On the need for a Duty of Candour

Sir, – On July 22nd this year following our successful court action against the HSE for the medical negligence in Lourdes Hospital Drogheda that left our daughter profoundly disabled we called on Minister for Health Leo Varadkar to introduce a statutory Duty of Candour.

This week, following yet another medical negligence case, the father of Roisín Conroy repeated his own plea from 2013 for the introduction of a statutory Duty of Candour.

How many children’s lives will have to be destroyed and how many hours will those children’s parents have to waste looking for answers that can and should be given to them directly after birth before the Department of Health addresses this issue?

A Voluntary Open Disclosure Policy, with zero consequences for non-compliance, is in no way comparable to a statutory Duty of Candour.
